The KENFRA Election and Transition Guidelines provide a comprehensive framework for the annual election process, the eligibility criteria for candidates, the nomination and voting procedures, as well as the smooth handover of leadership responsibilities. These guidelines ensure that the election is conducted fairly, transparently, and in accordance with KENFRA’s mission of promoting unity and cohesion among Kenyans in France.

By setting out clear processes and expectations, this document aims to:

  1. Ensure Fair Elections: The guidelines provide a clear, transparent framework for the election of the President, Secretary, and Treasurer, ensuring that these positions are filled with qualified, committed individuals who are aligned with KENFRA’s goals.
  2. Support Transition of Leadership: The transition process ensures a smooth handover from outgoing leaders to the new leadership. This promotes continuity, preserving KENFRA’s operations, and allows the new leadership to start with clear objectives and direction.
  3. Maintain Accountability: By establishing clear procedures for the election and transition, KENFRA guarantees that its leadership remains accountable to its members. It reinforces the organisation’s commitment to transparency, governance, and the long-term success of the Kenyan community in France.
  4. Empower the Community: The guidelines empower KENFRA members to actively engage in the election process, ensuring that every eligible member has the opportunity to participate in shaping the future leadership of the organisation.

This document will serve as a critical tool for KENFRA’s members, candidates, the Election Committee, and other stakeholders, ensuring that leadership transitions are seamless, democratic, and in the best interest of the entire Kenyan community in France.

1. General Principles and Objectives

1.1 Purpose of the Elections

The KENFRA election process is designed to ensure a transparent, democratic, and fair selection of key leadership positions. This document provides clear guidelines on how elections are conducted, from the appointment of the Election Committee to the declaration of results.

1.2 Guiding Principles

The election process shall adhere to the following principles:

  • Transparency: Ensuring openness in all election activities, from nominations to results.
  • Fairness: Providing equal opportunities for all eligible candidates and voters
  • Integrity: Upholding ethical conduct and preventing fraud and enforcing compliance with the election rules.
  • Inclusivity: Encouraging broad participation from all eligible members.
  • Accountability: Ensuring elected officials fulfil their responsibilities and remain answerable to members.

2. Election Committee

2.1 Appointment of the Election Committee

An independent Election Committee (EC) shall be appointed by the General Assembly at least three (3) months before the election date. The committee shall be responsible for organising and overseeing the entire election process to ensure transparency, fairness, and compliance with this procedure.

2.2 Composition and Structure

The EC shall consist of five (5) members, appointed through a transparent process by the General Assembly. The committee shall include:

  • Chairperson, responsible for leading the committee and overseeing all election activities.
  • Secretary, responsible for record-keeping and official election communication.
  • Other Committee Members, supporting election administration, voter verification, and dispute resolution.

2.3 Eligibility for the Election Committee

To ensure impartiality, members of the EC must meet the following criteria:

  • Must be members in good standing of KENFRA.
  • Must not be candidates in the election.
  • Must not hold any elective position in KENFRA during their term in the committee.
  • Must have demonstrated integrity, impartiality, and leadership within the association.

2.4 Term of Service

The EC shall serve from the date of appointment until the election process is completed and results are officially declared. This includes:

  • Organising and supervising candidate nominations.
  • Overseeing the campaign period and ensuring adherence to election rules.
  • Managing the voting process, including ballot collection, counting, and announcement of results.
  • Handling and resolving any election-related disputes.
  • Submitting a final election report within one (1) month after the election.

2.5 Disqualification and Replacement

A member of the EC may be removed and replaced if they:

  • Become a candidate in the election.
  • Exhibit bias or engage in activities compromising election integrity.
  • Resign or are unable to fulfil their duties due to unforeseen circumstances.

The General Assembly or the remaining EC members shall appoint a replacement in such cases.

3. Elective Positions

The following positions shall be filled through an annual election in August:

  1. President – Provides overall leadership, represents KENFRA, and oversees the organization’s strategic direction.
  2. Secretary – Manages official records, correspondence, and internal communication.
  3. Treasurer – Handles financial management, including budgeting, membership contributions, and financial reporting.

The full responsibilities of these positions are outlined in Section 2: Representative Mandates within the Office of the KENFRA By-laws and shall guide the elected officials in executing their roles.

3.1 Candidates Eligibility Criteria

To ensure fair representation and leadership within the Federation of Kenyan Associations in France (KENFRA), candidates seeking elective positions must meet the following eligibility requirements:

3.1.1 General Eligibility Requirements

  1. Active Membership

Candidates must be registered and active members of KENFRA for at least one year prior to the election date.

Proof of membership, including payment of annual dues, may be required.

  • Good Standing

Candidates must be in good standing with KENFRA, with no history of misconduct, disciplinary actions, or unresolved conflicts with the organization.

A background check may be conducted to ensure compliance with this requirement.

  • Kenyan Citizenship or Heritage

Candidates must be of Kenyan descent or legally affiliated with the Kenyan community in France.

  • Commitment to KENFRA’s Mission

Candidates must demonstrate a strong commitment to KENFRA’s mission of uniting, supporting, and promoting the Kenyan community in France.

Past involvement in KENFRA initiatives, events, or projects will be considered an added advantage.

  • Residency in France

Candidates must be legally residing in France and available to fulfil their responsibilities throughout their term in office.

  • French Language Skills

Candidates must be proficient in the French language, both written and spoken, as this is crucial for effective communication within the French context.

3.1.2 Position-Specific Eligibility Requirements

In addition to the general criteria, candidates for each position must meet the following specific requirements:

  1.  President
  2. Must have prior leadership experience in community organisations, non-profits, or professional networks.
  3. Must possess strong organizational, strategic, and public relations skills to effectively represent KENFRA.
  4. Must demonstrate a clear vision for the Federation and articulate strategies for community development.
  5. Must have excellent communication and negotiation skills, as they will be responsible for liaising with stakeholders, including Kenyan and French authorities, partner organisations, and community members.
  6. Secretary
  7. Must have experience in administrative management, documentation, or secretarial duties.
  8. Must demonstrate strong organizational and communication skills, ensuring proper record-keeping, timely communication, and efficient coordination of meetings.
  9. Must be proficient in written and verbal communication in both English and French to handle correspondence and documentation effectively.
  10. Experience in database management or information systems will be an added advantage.
  11. Treasurer
  12. Must have a background in finance, accounting, or financial management.
  13. Must demonstrate high integrity and transparency in handling KENFRA’s finances.
  14. Must be proficient in financial reporting, budgeting, and bookkeeping.
  15. Experience in fundraising or managing community financial contributions will be an added advantage.

3.2 Additional Considerations

3.2.1 Conflict of Interest

Candidates holding leadership positions in other organizations that may conflict with KENFRA’s interests must declare such affiliations before contesting.
The Election Oversight Committee (EC) reserves the right to assess and determine potential conflicts of interest.

3.2.2 Code of Conduct Compliance

All candidates must pledge to abide by KENFRA’s Code of Conduct and uphold ethical leadership practices. Any violation of the code may result in disqualification from the election process.

3.3 Nomination Process

The nomination process is crucial to ensuring that the election is transparent, fair, and inclusive. It involves the steps by which potential candidates are identified and confirmed for the election.

3.3.1 Nomination Period

A nomination period will be announced in advance, typically one month prior to the election, allowing enough time for individuals to prepare their candidacies. It will last for two weeks, during which members can submit their nominations.

3.3.2 Nomination Submission

Nominations may be submitted by self-nomination or nomination by another active member.

Nomination forms will be made available on the KENFRA website or can be requested from the Election Committee (EC).

Candidates are required to fill out a nomination form, which includes:

  • Personal information (name, contact details, etc.).
  • Position being contested.
  • A statement of intent outlining their goals, experience, and why they believe they are suitable for the position.
  • A brief summary of past involvement with KENFRA or other community-based organizations, if applicable.

3.3.3 Nomination Criteria

Nominations will only be accepted for candidates who meet the general eligibility requirements outlined in Section 3.1.

All nominees must submit their nomination forms along with:

  • Proof of active membership (e.g., proof of payment of dues).
  • A letter of recommendation from an active member or KENFRA representative (optional but encouraged).
  • A declaration stating that they accept the nomination and are committed to fulfilling the duties of the position if elected.

3.3.4 Verification of Nominations

The Election Committee will review each nomination to ensure that candidates meet the eligibility criteria.

The Election Committee will verify the validity of the nomination, ensuring that all documentation is complete and accurate.

If any discrepancies or issues are identified, the Election Committee will contact the nominee for clarification or to provide a chance to rectify the situation.

3.3.5 Announcement of Qualified Candidates

After verifying nominations, the Election Committee will publish a list of qualified candidates on the KENFRA website and through other communication channels.

This announcement will include the names of the nominees, the positions they are running for, and their brief statements of intent.

The final list of qualified candidates will be made available to all members at least two weeks before the election date.

3.3.6 Deadline for Nominations

The nomination period will officially close at 6:00 PM on the last day of the nomination window. No nominations will be accepted after this time.

If no nominations have been made for a particular position close to the deadline, the Election Committee may extend the period for the specific position.

Any incomplete or invalid nomination submissions will be disqualified.

4. Campaign Period

The campaign period will officially begin immediately after the confirmation of candidates and will run until the eve of the election. This period provides candidates with an opportunity to present their plans, ideas, and qualifications to KENFRA members in an organised and structured manner.

4.1 Duration and Key Dates

The campaign period will last for at least one week before the election date.

The exact dates of the campaign period will be determined and announced by the Election Committee each election year.

Campaigning must end by midnight on the day before the election to allow members time to reflect before casting their votes.

4.2 Campaign Code of Conduct

To ensure fairness, candidates and their supporters must adhere to the following rules:

  • Respectful Conduct- No defamatory statements, personal attacks, or false claims about other candidates.
  • Equal Opportunity- No candidate should use their current or past position in KENFRA to gain an unfair advantage.
  • Transparency in Messaging- Campaign messages should be clear, truthful, and focused on the candidate’s vision, experience, and proposed contributions to KENFRA.
  • Prohibited Activities- Candidates are not allowed to:
    • Offer incentives or gifts in exchange for votes.
    • Use unauthorised KENFRA resources (such as official databases or mailing lists) for personal campaign purposes.
    • Engage in negative campaigning that undermines the unity of KENFRA.

4.3 Candidate Debates & Forums

The EC will organise at least one debate or panel discussion where candidates can present their ideas and respond to questions from members.

The debate will be moderated and streamed online to ensure accessibility for all members across France.

Questions may be submitted in advance or asked live during the event.

4.4 Monitoring & Compliance

The Election Committee will oversee the campaign process to ensure compliance with KENFRA’s electoral guidelines.

Any reports of misconduct or violations of campaign rules will be investigated, and penalties (ranging from warnings to disqualification) may be applied.

Members are encouraged to report any unfair practices to the EC.

4.5 End of Campaign Period

Campaigning must stop 24 hours before election day to allow voters to make independent decisions without last-minute influence.

Any candidate found campaigning beyond the deadline may face penalties or disqualification.

5. Voting Process

The voting process is the cornerstone of KENFRA’s democratic election system. It is designed to ensure that elections are free, fair, and transparent, allowing all members to have a voice in choosing the leadership of the organisation. Below are the key details of the voting process:

5.1 Eligibility to Vote

Active Membership: Only registered and active members of KENFRA or member associations are eligible to vote.

5.2 Voting Method

KENFRA will adopt a secure, transparent, and inclusive voting process.

Electronic Voting: The election will be conducted primarily through electronic voting (e-voting) to ensure accessibility and participation from all members, regardless of their location in France. A secure online platform will be used to facilitate voting.

5.3 Voting Period

The voting will take place on a designated election day, as decided by the Election Committee (EC).

The voting period will be open for 8 hours, beginning at 9:00 AM and closing at 5:00 PM (Paris time).

Voting will be time-limited, and members must cast their votes within the specified timeframe.

5.4 Voting Instructions

  • Eligible voters will receive a unique, secure voting link via email, which they will use to log into the voting platform.
  • Voters must use their full name and KENFRA membership number to verify their identity before voting.
  • Once logged in, voters will be able to view candidate profiles and make their selections for each position.
  • After casting their vote, members will receive a confirmation email acknowledging their vote has been successfully submitted.

5.5 Voting Confidentiality

Voting is confidential. The identities of voters and their selections will be kept anonymous to protect the integrity of the election process.

Voters are encouraged to make their choices independently and without interference, ensuring that their votes reflect their personal preferences.

5.6 Vote Counting & Results

Electronic Voting Results: After the voting period closes, the EC will immediately begin the process of verifying the electronic votes and counting the results.

Transparency in Results: The EC will announce the results of the election within 48 hours after the voting period ends. A public announcement will be made through KENFRA’s official communication channels.

If necessary, the EC will conduct a recount to ensure the accuracy and fairness of the results.

5.7 Election Dispute Resolution Process

The Election Committee (EC) shall be the first point of contact for handling any election-related disputes. All grievances must be formally submitted in writing to the EC within 48 hours after the incident or election results announcement. The following procedure shall be followed:

Step 1: Submission of Complaint

Any candidate, voter, or member of KENFRA may file a written complaint with the EC.

The complaint must include:

  1. The name and contact details of the complainant.
  2. A clear description of the issue, including relevant evidence.
  3. The relief or resolution sought.

Step 2: Review and Investigation

The EC shall acknowledge receipt of the complaint within 24 hours.

A hearing may be conducted if necessary, allowing all concerned parties to present their cases.

The EC shall investigate the matter, review any submitted evidence, and consult relevant stakeholders if needed.

Step 3: Decision and Resolution

The EC shall issue a formal decision within seven (7) days of receiving the complaint.

Possible resolutions may include:

  1. Dismissal of the complaint if deemed unsubstantiated.
  2. Issuance of a warning or directive to ensure fairness.
  3. If a serious violation is confirmed, the EC may recommend actions such as a re-vote, disqualification of a candidate, or disciplinary measures.

The decision of the EC shall be final and binding, unless a formal appeal is submitted.

Step 4: Appeal Process

If the complainant is dissatisfied with the EC’s decision, they may appeal to an Independent Review Panel, appointed by the General Assembly.

The appeal must be submitted within 48 hours of the EC’s decision.

6. Appointed (Non-Elective) Positions

In addition to the three elective positions (President, Secretary, and Treasurer), the following non-elective positions may be filled by appointment to support the leadership structure and ensure the effective functioning of the association.

6.1 Sports Coordinator

Objective:

To oversee, develop, and implement sports programs within the association, ensuring high-quality activities, athlete development, and community engagement.

Key Responsibilities:

  • Program Development: Plan, organize, and manage sports programs, leagues, and events.
  • Athlete Development: Implement training programs and ensure access to coaching and resources.
  • Community Engagement: Promote sports participation and organize outreach programs.
  • Compliance & Safety: Ensure adherence to sports regulations and safety standards.
  • Collaboration: Work with coaches, volunteers, and governing bodies to improve sports offerings.

Skills & Qualifications:

  • Experience in sports program coordination or coaching.
  • Strong leadership, organizational, and communication skills.
  • Knowledge of sports regulations and athlete development strategies.

6.2 Communications Coordinator

Objective:
To manage the association’s internal and external communications, ensuring that all messaging is consistent, impactful, and aligns with the association’s objectives.

Key Responsibilities:

  • Content Creation: Develop content for newsletters, websites, social media, and marketing materials.
  • Internal Communications: Ensure clear and effective communication within the association’s teams and with stakeholders.
  • External Communications: Handle media relations, press releases, public relations campaigns, manage newsletters and social media to keep members informed and involved.
  • Brand Management: Maintain and promote the association’s brand identity.
  • Campaigns & Promotion: Design and execute communications campaigns to promote the association’s activities and mission.
  • Monitoring & Reporting: Track the effectiveness of communication strategies and report on their impact.

Skills & Qualifications:

  • Background in Communications, Marketing, or related field.
  • Experience in digital marketing, content creation, and media relations.
  • Strong writing, editing, and communication skills.
  • Proficiency in social media platforms, CRM systems, and communications tools.

6.3 Project & External Partnerships Coordinator

Objective:

To design, implement, and manage projects that align with the association’s mission, ensuring effective resource utilisation, stakeholder engagement, and sustainable growth. Additionally, to establish and maintain strategic partnerships with external organisations, businesses, and corporate sponsors.

Key Responsibilities:

  • Project Planning & Strategy: Identify needs, define objectives, and develop project roadmaps.
  • Funding & Budget Management: Secure grants, sponsorships, and manage financial resources efficiently.
  • Implementation & Coordination: Oversee project execution, ensuring timely delivery and quality outcomes.
  • Stakeholder Engagement: Collaborate with internal teams, external partners, and community members.
  • Monitoring & Evaluation: Track project progress, assess impact, and recommend improvements.
  • Partnership Development: Identify, initiate, and maintain relationships with external partners and sponsors.
  • Networking & Representation: Represent the association at industry events, conferences, and business forums.

Skills & Qualifications:

  • Experience in project development, partnership management, or corporate relations.
  • Strong leadership, organisational, and communication skills.
  • Knowledge of funding mechanisms, grant writing, and stakeholder management.

6.4 Arts, Culture & Advocacy Coordinator

Objective:
To promote, develop, and manage artistic and cultural programmes that enrich the community, preserve heritage, and encourage creative expression.

Key Responsibilities:

  • Programme Development: Organise cultural events, exhibitions, performances, and artistic workshops.
  • Community Engagement: Foster participation in arts and cultural initiatives across diverse groups.
  • Heritage & Cultural Preservation: Support initiatives that preserve and celebrate local traditions, history, and artistic heritage.
  • Funding & Sponsorship: Secure grants, sponsorships, and manage budgets for cultural projects.
  • Education & Awareness: Promote arts education and encourage artistic skill development through training and mentorship.
  • Advocacy & Awareness: Promote causes relevant to the community through events, campaigns, and outreach.

Skills & Qualifications:

  • Knowledge of arts funding, grant writing, and sponsorship strategies.

6.5 Membership & Outreach Coordinator

Objective:
To grow and engage the association’s membership base while strengthening relationships with the community through outreach initiatives.

Key Responsibilities:

  • Membership Growth & Retention: Develop strategies to attract, engage, and retain members.
  • Outreach & Engagement: Organise community outreach programmes, networking events, and engagement activities.

  • Partnership & Collaboration: Build relationships with external organisations, sponsors, and community groups to expand the association’s reach.
  • Member Support & Services: Address member inquiries, enhance member benefits, and improve overall experience.
  • Data & Feedback Management: Track membership trends, analyse engagement metrics, and gather feedback for continuous improvement.

Skills & Qualifications:

  • Experience in membership management, community outreach, or stakeholder engagement.
  • Strong communication, networking, and organisational skills.
  • Ability to develop marketing campaigns and outreach strategies.

6.6. Legal & Compliance Coordinator

Objective:
To ensure the association operates within legal and regulatory frameworks, overseeing compliance, governance, and legal risk management.

Key Responsibilities:

  • Legal Compliance: Ensure adherence to local, national, and international laws, including nonprofit regulations.
  • Governance & Policy Development: Support board governance, draft internal policies, and ensure ethical best practices.
  • Risk Management: Identify legal risks and develop strategies to mitigate them.
  • Dispute Resolution: Handle legal disputes and oversee conflict resolution processes.
  • Data Protection & Intellectual Property: Ensure compliance with data protection laws (e.g., GDPR) and manage intellectual property rights.

6.7 Fundraising & Development Coordinator

Objective:
To develop and execute fundraising strategies that generate financial support for the association’s programmes, ensuring sustainability and growth.

Key Responsibilities:

  • Fundraising Strategy: Develop and implement fundraising campaigns, events, and initiatives.
  • Donor Engagement: Identify, cultivate, and maintain relationships with donors, sponsors, and funding organisations.
  • Grant Writing & Proposals: Research and apply for grants, sponsorships, and other funding opportunities.
  • Corporate Partnerships: Establish and manage sponsorship agreements and collaborations with businesses.
  • Event Planning: Organise fundraising events, charity auctions, and community donation drives.

  • Marketing & Communication: Promote fundraising efforts through social media, email campaigns, and networking.

6.8 Service & Community Development Coordinator

Objective:

To enhance community engagement and deliver impactful services that align with the association’s mission, fostering inclusivity, support, and development within the community. 

Key Responsibilities:

  • Community Engagement: Develop initiatives that encourage participation and strengthen relationships with members. 
  • Service Development & Delivery:       Design and implement programs that address community needs (e.g., education, health, sports, social services). 
  • Volunteer & Member Coordination: Recruit, train, and manage volunteers to support various programs. 
  • Partnership & Collaboration: Work with local organizations, government agencies, and sponsors to enhance services. 
  • Advocacy & Awareness: Promote causes relevant to the community through events, campaigns, and outreach.     
  • Monitoring & Impact Assessment: Evaluate service effectiveness and make improvements based on feedback and data. 

Skills & Qualifications:

  • Experience in nonprofit management, social services, or community engagement. 
  • Strong communication, leadership, and problem-solving skills. 
  • Ability to develop partnerships and secure funding for community programs.
